A resignation letter in Mexico needs five things: the date, the employer's name, a clear statement that you are resigning voluntarily, your last working day, and your signature. Mexico's Federal Labor Law does not require a specific format and does not force you to give advance notice, though giving 15 calendar days' notice is the professional norm. Resigning does not cancel your finiquito (final settlement): prorated Christmas bonus, unused vacation, and vacation premium are still owed to you even when you quit on your own.

What a resignation letter must include
The goal is to put in writing that the separation was your decision. That protects your settlement and your references. A correct letter includes:
- Place and date (e.g. "Monterrey, N.L., July 22, 2026").
- Recipient: the company name and HR or your direct manager.
- Statement of intent: the key phrase is "I hereby submit my voluntary and irrevocable resignation."
- Last working day (or effective date of the resignation).
- A brief thank-you (optional, but it helps your references).
- Full name and signature.

Do I have to give 15 days' notice?
Legally, no. The law does not require an employee to give notice when resigning. The exception is when your individual contract or the collective bargaining agreement sets a notice period — then that period binds you. Even when it is not required, two weeks' notice makes three things easier: fast payment of your settlement, a clean handover of projects and passwords, and good references for your next search. In a market where 80% of professional openings are already remote or hybrid — based on active listings in our job board — leaving on good terms positions you better for the next move.
What severance do I keep if I resign?
The finiquito (settlement for resignation) is different from liquidación (severance for dismissal). When you resign voluntarily there is no three-month indemnity, but you are still owed the proportional amounts you already earned:
- Prorated Christmas bonus (aguinaldo): a legal minimum of 15 days' salary per year, calculated by the months worked.
- Unused vacation and vacation premium (at least a 25% premium on those days).
- Days worked and unpaid in the current period.
These benefits come from the "dignified vacation" reform and are a floor: your contract can grant more, never less. Before signing your settlement, check that the math adds up.
Resigning to take a better offer
Many people resign because they already hold a better offer. If that is your case, get the numbers straight first — pay varies widely by city and specialty. Among active developer listings, for example, the median in Mexico City is around $67,000 MXN per month (≈ $3,850 USD), versus about $62,875 MXN (≈ $3,600 USD) in Guadalajara, at 17.39 MXN/USD, July 2026. See real ranges by role in our systems engineer salary data, and explore professional openings by city before handing in your letter. If your goal is to work without an office, check remote job listings.
How to deliver your letter (without burning bridges)
How you hand it in matters as much as the text. Follow these steps:
- Talk to your manager first, in person or on a video call. Finding out from the letter is the worst way. The conversation comes before the document.
- Deliver the letter with proof of receipt. Ask HR to sign a copy, or send it by email with a delivery record. No receipt means no proof of the date.
- Offer a transition plan. A short list of your open tasks and the accesses to hand over leaves a good impression and speeds up your settlement.
- Mind your tone through the last day. References are built in the final two weeks as much as in the prior years.
Leaving well positions you better for your next move. If you're already exploring options, browse openings by city and function and compare them against what you earn today.
Frequently asked questions
Should I resign in writing or verbally?
Always in writing and with proof of receipt (a copy signed by HR, or an email with a delivery record). The letter is your evidence that the separation was voluntary and of the effective date.
Do I lose my Christmas bonus if I resign?
No. The prorated aguinaldo is owed for the months you worked in the year, regardless of resignation. It must be paid as part of your settlement.
Can the company withhold my settlement if I don't give notice?
Not legally. The settlement is a right. Giving notice helps the payment go quickly and smoothly, but skipping it does not erase what you are owed.
Should I state my reason for leaving?
It is neither necessary nor advisable. Stating that you resign voluntarily is enough. Save the reason for a separate conversation — or the exit interview — to protect your references.
